SDSA MEMBERSHIP
Insurance for SDSA Members has now been rolled into Membership. You can have membership at two levels, one with £5m public liability cover, and one with £10m cover.
Public Liability and Professional Indemnity insurance cover you in event of a claim against you arising out of bodily injury or property damage by a member of the public (including a client) in the course of your work, or arising as a result of your alleged negligence. The insurance will cover you for any legal costs incurred in defending the claim and any costs you may need to pay as compensation to the person making the claim.
For example, a client might claim a neck injury following a hard manoeuvre and being unable to work as a result. Even where a disclaimer has been signed, that client could sue you for compensation as you have a duty of care to ensure your activity causes no harm to other people.
The history of claims through ‘no win no fee’ legal services have created a growing culture where individuals attempt to claim compensation for accidents even when the chances of successfully proving liability are small. Legal costs can be significant before the case ever reaches court, and there has been a tendency to pay settlements rather than incur these costs. This has in turn led to an increase in spurious claims.
Public liability insurance is not mandatory by law but is often a contractual requirement as your client may want to ensure you have adequate protection in the event of an accident. For this reason, many companies and organisations now insist on their suppliers having public liability cover in place to ensure there will be protection in the case of a claim of this sort.
